News Title:	Partner of Consortium El Salvador contributes in the victory of El Salvador in the CIADI
News Details:
An arbitral tribunal at the International Center for the Settlement of Investment Disputes (ICSID) issued an interlocutory award declining jurisdiction in favour of the Republic of El Salvador, in the arbitration brought by the Spanish company INCEYSA VALLISOLETANA, S.A, claiming $122 million. Arnold & Porter, counsel for the Republic of El Salvador, engaged the services of Consortium El Salvador. Partner José Roberto Tercero prepared the opinions on issues of Salvadoran public law and appeared as expert witness in the hearings at the World Bank Headquarters in Washington D.C. The award, in substance, decides that ICSID has no jurisdiction to arbitrate the dispute, neither under the Investment Law of El Salvador nor under the Bilateral Investment Treaty between Spain and El Salvador, given that the claimant cannot access the protection afforded by these instruments because her investments in El Salvador were obtained by fraud and in violation of Salvadoran public law.
